About Noctua

Noctua is a self-reflection app for dream tracking, menstrual cycle tracking, and shadow work. Noctua is operated by AGNÉLIS, a sole trader registered in the United Kingdom. Address: Bradford BD6 1RE, West Yorkshire, United Kingdom. Contact: contact.agnelis@gmail.com.

Acceptance of terms

By using Noctua, you agree to these Terms of Service and our Privacy Policy. Acceptance is required at account registration through ticking the corresponding boxes. If you do not agree to any of these terms, please do not use the app.

AI and mental health disclaimer

Noctua is a self-reflection tool, NOT a diagnostic or treatment tool. Content generated by artificial intelligence (AI) is reflective in nature only and does not constitute medical, psychological, psychiatric, or therapeutic advice.

Noctua does not replace professional healthcare, therapy, or psychological consultation. Life decisions made based on AI-generated content are your sole responsibility.

Mental health crisis and emergency help

In a mental health crisis, suicidal thoughts, self-harm or risky behaviour, please immediately contact a professional or helpline. In the Grounding section in the app you will find a list of helpline numbers for the UK, the USA, and Poland. UK emergency numbers: Samaritans 116 123, NHS Mental Health Crisis Line 111 (option 2). US numbers: 988 Suicide & Crisis Lifeline (call or text 988). Polish numbers: Telefon Zaufania 116 123, Centrum Wsparcia 800 70 2222.

Noctua recognises words in your text that indicate a crisis and then shows you helpline numbers. What exactly we record at that moment, and what we do not record, is described in the Crisis detection section of the Privacy Policy.

Account

You must be at least 16 years old to use Noctua. By accepting these Terms, you declare that you have reached the age of 16. You are responsible for the security of your account and password. One account per person rule applies. You may not transfer, sell, or share your account with another person.

Payments and subscriptions

Payments are processed by Stripe. Subscriptions renew automatically. You may cancel your subscription at any time through the Stripe customer portal.

One-time purchases (reports, workbooks, colour themes) are non-refundable once digital content has been delivered. Subscriptions may be cancelled at any time, but the fee for the current billing period is non-refundable.

AGNÉLIS reserves the right to modify subscription pricing and shop product pricing. We will provide at least 30 days' notice for significant price changes. For payment issues, contact contact.agnelis@gmail.com.

Right of withdrawal (UK): By clicking the purchase button, you confirm that you request immediate delivery of digital content and that you understand you thereby waive your statutory right to withdraw from the contract within 14 days. This does not apply to subscriptions. You may cancel your subscription at any time as set out in the Payments section.

Your content and licence

Everything you write in Noctua (journal, dreams, shadow work entries) remains your intellectual property. We do not use your content for marketing purposes or share it with third parties.

You grant AGNÉLIS a non-exclusive, limited licence to process your content solely to provide services to you: displaying entries, generating personalised reports and questions, tracking patterns. The licence expires automatically when your account is deleted.

Reports, workbook summaries, and other AI-generated content based on your entries are your property and accessible only to you. We do not use them for any purpose beyond providing the service. This content is permanently deleted along with your account.

Experimental and beta features

Some app features may be marked as experimental, beta, or in testing. These features are provided on an as-is basis without warranty of full functionality, stability, or permanent access. AGNÉLIS reserves the right to modify or withdraw them at any time.

Account suspension and termination

AGNÉLIS may suspend or terminate your account without prior notice in the following situations:

• Violation of these Terms
• Behaviour threatening other users or platform security
• Attempts to bypass security, hacking, reverse engineering
• Creating multiple accounts to bypass limits
• Illegal use of the app or its content
• Failure to pay subscription fees

You have the right to export your data before account closure, by request sent to contact.agnelis@gmail.com. After account closure, all data is deleted as per the Privacy Policy within 30 days.

Limitation of liability

Noctua is provided on an as-is basis. We do not guarantee uninterrupted or error-free service. AGNÉLIS is not liable for decisions made based on AI-generated content.

To the maximum extent permitted by law, AGNÉLIS' total liability to a user is limited to the amount paid by her for Noctua services in the 12 months preceding the claim, but no more than GBP 100. The above limitation does not exclude liability where such exclusion is prohibited by law (e.g. death, intentional bodily harm, breach of consumer obligations).

Force majeure

AGNÉLIS is not liable for unavailability or malfunction of the service caused by events beyond its control, including in particular: failures of external services (Vercel, Supabase, Anthropic, Stripe, Resend, Sentry), hacking attacks, natural disasters, pandemics, government actions, power or Internet outages.

Indemnification

You agree to indemnify AGNÉLIS against all claims, losses, costs and expenses (including legal fees) arising from third party claims related to content you post in the app, in particular entries concerning other persons, infringement of their privacy or personal rights.

Changes to service

AGNÉLIS reserves the right to modify, add, or remove app features at any time. For significant changes affecting paid features, users will be notified at least 14 days in advance by email or in-app notification.

Notice before legal proceedings

Before taking legal action against AGNÉLIS, you agree to notify us in writing at contact.agnelis@gmail.com with a description of the issue and proposed resolution. AGNÉLIS has 60 days to resolve the dispute amicably before you take further legal steps. This provision does not limit your consumer rights.

Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from the use of Noctua will be resolved before courts having jurisdiction in England and Wales, unless applicable consumer protection laws state otherwise.

Severability

If any provision of these Terms is held invalid, unenforceable, or void by a court or other competent authority, the remaining provisions remain in full force and effect to the maximum extent permitted by law.

Survival of provisions

The following provisions survive account closure or contract termination: AI and Mental Health Disclaimer, Your Content and Licence, Limitation of Liability, Indemnification, Notice Before Legal Proceedings, Governing Law and Jurisdiction, Severability.

Referral programme

Noctua offers a referral programme where you can invite others and unlock rewards. The invited person must create an account and make at least 3 entries (journal, dreams, or shadow work) for the invitation to count as active.

Reward thresholds: 3 active invites: 1 free dream reading. 5 active invites: exclusive Moonstone theme. 10 active invites: 30% off any workbook + 2 dream readings. 15 active invites: exclusive Velvet Night theme. 20 active invites: 30% off Premium subscription + 3 dream readings. 30 active invites: exclusive Obsidian Rose theme + Ambassador badge. 50 active invites: lifetime unlimited dream readings.

Rewards are granted automatically upon reaching the threshold. AGNÉLIS reserves the right to modify thresholds and rewards at any time.

Free and Premium tiers

The free tier includes: journal, dream journal, cycle tracker, and shadow work with prompts based on moon position. The journal, dream journal, and cycle tracker support your own insight and do not use AI. Dream symbols include 8 basic meanings. The grounding section with crisis helpline numbers is available free of charge. The free tier does not include AI features or reports.

Premium subscription (GBP 9.99/month or GBP 79.99/year) includes everything in the free tier, plus: three layers of shadow work (moon position prompts, seasonal prompts, and AI generated personalized prompts after 15 entries), the Full Reading (after 15 entries), 5 dream readings per month (GBP 1.49 per additional after the limit), and 50 dream symbols. The subscription also unlocks three workbooks: Shadow Work, Dream Integration, and Cycle Alignment. Upon cancellation, you retain read-only access to all previously generated content; active (in-progress) workbook sessions may be completed, but new sessions and new AI content will not be available until the subscription is resumed or a separate purchase is made.

Products available as separate purchases in the shop include: reflection (after 5 entries), pattern recognition (after 15 entries), individual dream readings, extended dream symbols dictionary (50 symbols, available to free tier users as well), colour themes, and other occasional content. Some purchases may require a minimum number of entries before becoming available. These products are available to both free tier and Premium users. Free tier users may also separately purchase the Shadow Work, Dream Integration, and Cycle Alignment workbooks (which are included in the Premium subscription). Premium subscribers may additionally purchase planetary workbooks based on their birth data: Moon, Saturn, Pluto, Chiron, and Lilith. The Lunar Nodes workbook is available as a separate purchase after the application detects at least two genuinely worked through shadow patterns. Planetary workbooks are not available to free tier users.

Changes to these terms

We reserve the right to update these Terms. We will inform you of significant changes by email or in-app notification at least 30 days before they take effect. Continued use of Noctua after the changes take effect constitutes acceptance. The date of the last update is shown at the top of this page.

AGNÉLIS intellectual property

The Noctua application, its logo, name, visual design, source code, editorial content, and all materials created by AGNÉLIS are protected by copyright and are the property of AGNÉLIS. You may not copy, reproduce, modify, distribute, or create derivative works without AGNÉLIS's written permission.

Prohibited uses

The following are prohibited:

• Automated data collection (scraping) from the app
• Reverse engineering, decompiling, or analysing the source code
• Sharing account access with others for commercial purposes
• Using Noctua to generate content for sale or for third parties
• Attempting to manipulate the AI system, bypass security measures, or overload servers
• Creating multiple accounts to circumvent limits or rewards
• Using the app for any unlawful purpose

Entire agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and AGNÉLIS in relation to your use of Noctua and supersede all prior agreements, representations, or understandings relating to the same subject matter.
